My son just had a baby, born on December 28,2006. I was wondering if he is still allowed to take the earned income credit, seeing as how his son was born at the end of the year, and the tax rules state that a dependant child has to be living with you and supported by you for at least 50% of the year. Also, just to let you know he did live with and totally support the childs mother during her entire pregnancy, I don't know if that counts or not. Any help would be appreciated.

Your son can claim EITC for the new born child provided he has earned income and pass other tests for EITC. A child born and lived for any moment in 2006 is considered as lived with your son for whole year.  IRS came up with a calculator for checking the eligibiliy for EITC.
