Hello,

W9 form says an individual who is citizen or resident of the united states, required to file the W9 form.

I have H1B visa and working here from last 3 years, Am I US resident , Can I file W9 when I file the returns?

W-9 form is used by your employer or those who make payment to you to request your tax identification number (TIN). You don't send it to IRS or include in your tax return. If you are asked to fill it by your employer, it is done as a formal document to certify that you are providing the correct TIN number to them and they use it while filing the information return to IRS.

Since you are in US for last 3 years you are a US Resident for tax purposes.
